RENTAL AGREEMENT AND POLICIES FOR TRANSIENT OCCUPANCY
THIS AGREEMENT (herein “Form”), between the Vacation Rental Guests (herein “Guest”) and Lake Tahoe Mountain Vacations (herein “LTMV”), is made in the Town of Truckee, State of California. The Guest must accept this Form as agreed to and such acceptance shall be on file with LTMV. This Form applies to all future rental agreements between the Guest and LTMV of any properties (herein “Unit”) booked through LTMV.
ARRIVAL & DEPARTURE TIME: Check-in time is after 3:00 p.m. and check-out time is BY 10:00 a.m. No exceptions will be made unless authorized by LTMV in advance for each Guest stay. There will be a $40 CHARGE PER HOUR FOR LATE CHECK-OUTS PAST 10:00 a.m. that were not approved at least 24 hours in advance with Lake Tahoe Mountain Vacations.
COLLECTION OF LODGING: The lodging will be collected via check to be mailed at the time of booking (made out to Lake Tahoe Mountain Vacations or Beth Ham for her personally owned condos, Ski View #1 & Coyote Fork #1, Catamount), or payment via PayPal with a 5% fee (for out of country guests only) will be made to LTMV at the time of booking. Checks will not be cashed nor charges made to credit cards for the amount of agreed upon rent until 2 weeks (or one month, 6 weeks for holiday periods, for the amount of deposit if a cancellation is made) prior to Guest’s scheduled date of arrival.
The applicable portion of the cancellation policy is dependent upon the time of the cancellation:
1) If a reservation is cancelled more than one month in advance (or six weeks for holiday periods), no funds will be forfeited by the Guest except for fees incurred by LTMV if rental payment was made via a direct deposit.
2) If a reservation is cancelled less than one month but more than two weeks (less than six weeks but more than one month for holiday periods) prior to the stay, the amount of the security deposit will be forfeited by the Guest plus any fees incurred by LTMV if rental payment was made via a direct deposit.
3) If a reservation is cancelled two weeks or less (or less than one month for holiday periods) prior to the check-in date of stay, all of the funds collected for that stay are forfeited. If there is an announced road closure for a consecutive 24 hour period on the date of your arrival, Guest will be credited for the amount of rent for that night only, not for the entire amount of the reservation. In this case, no refund is made to the Guest, but the amount of rent for that night with be credited for a future stay. If you do not show for your rescheduled reservation, or you stay less than reserved dates, services shall be considered rendered and no further refund will be made.
CONDITIONS BEYOND OUR CONTROL: Guest acknowledges that LTMV has no control over many situations; no refunds will be issued for weather, snow or road conditions, power, cable television or telephone outages or other acts of nature, nor is any guarantee or warranty made as to the condition or quality of televisions, appliances, and the like. Every reasonable attempt will be made to put them in proper working order during your stay. Beyond this notification and these options offered, the company shall bear no further responsibility unless otherwise indicated. LTMV WILL BE HELD HARMLESS DUE TO EVENTS THAT ARISE FROM NATURALLY OCCURING HAZARDS AND UNFORESEEN AND/OR UNPREDICTABLE OCCURRENCES. Guest is hereby alerted to the fact that certain hazards, and unforeseen and/or unpredictable occurrences are inherent with geographical location of Tahoe, including but not limited to those that arise from weather, altitude and/or being the natural habitat of wild animals. It is the Guest's responsibility to familiarize themselves with such possible occurrences. Further, LTMV shall not be held responsible for any latent defects within or without the rental property that are beyond the scope of a diligent search for such defects. Guest agrees to hold LTMV and/or it's agents harmless in the event of any damage or injury to self or property, or to any additional persons staying with the Guest during this rental or any other person whomsoever in connection with the rental of the property that results from accident, injury, any effects of snow, ice, flood, defective construction, fire, theft, injury caused by contact with animals, and the like. LTMV also shall not be liable for any error of judgment or for any mistake of fact or law, or for anything which it may do or refrain from doing hereunder, except in cases of willful misconduct, or gross negligence.
KEYS / ACCESS TO THE RENTAL UNIT: The reservation must be fully paid for and this contract accepted, signed, and on file with LTMV before key codes for lockboxes will be released to the Guest prior to their stay.
PETS: NO PETS ARE ALLOWED. Evidence of a pet found in your Unit during your stay could be grounds for immediate eviction and NO refund of rent. You will be charged the cost of cleaning the carpets and furniture and for any damages caused by the pet.
PARTIES: LTMV does not allow large parties of any kind in or at any of our Units. Parties or gatherings of more than twice the number of Guests listed as maximum capacity of your Unit will be considered as a breach of the content of this Form and could be grounds for immediate eviction and NO refund of rent. Noise output must be strictly controlled, including the volume of any music. No musicians or entertainment is allowed outside. No yelling or loud activity is allowed in the street. Please close windows and doors when possible to help control noise. Disturbing the peace or disturbance of your neighbors or any illicit activity is a violation of local ordinance. If law enforcement officers are called, come to the Unit and fill out a substantiated "disturbance report” or similar complaint, eviction will be immediate and all of your rental funds will be forfeited.
SMOKING: There is absolutely NO SMOKING in any of our Units. Any Guests that do so will be charged to have all carpets, upholstery and drapes cleaned by a professional cleaning service.
BICYCLES & SKI/SNOWBOARD EQUIPMENT: Absolutely NO BIKES are allowed in the condos. Bikes can be locked outside the condos or kept locked inside or on top of cars. Anyone who brings a bike inside the condo will be charged repainting fees for scuff marks on walls as well as carpet cleaning costs. All of our units have ski lockers for our guests' use, so please store all skis and snowboards there.
MISSING OR DAMAGED PROPERTY: If property belonging to the Unit and/or LTMV is found missing or damaged by the Guest, the cost of replacement of or repair to that property will be made to your credit card or taken out of your damage deposit check.
FIREPLACE USAGE: Please do not touch fireplace settings on the actual fireplace units. Most of our fireplaces are controlled via hall thermostats, so please do not change the settings ON the fireplace units. Fireplace operation instructions are included in the condos.
TELEPHONE CALLS: Local and toll-free calls are free of any charges in Units with telephones. Tenants making long distance toll-type calls will encounter a call blocking system, which will allow the use of most phone calling cards and major credit cards.
GUEST'S RESPONSIBILITIES AT CHECKOUT OF THE RENTAL PROPERTY: Load all dirtied dishes and cooking utensils in the dishwasher and run it. All food must be removed from the refrigerator (including the freezer) and discarded. All trash must be removed from the Unit and placed in the dumpsters provided in the parking lots or by the entrance to Northstar. Thermostats must be set at 55 degrees when you leave the Unit, and fireplaces turned off. Leave the NPOA Recreation Center (Rec) card in the Unit. A $50 replacement fee will be charged to Guests who do not leave the Rec card in the Unit upon departure. Keys must be returned to lock box/Unit or a $25 replacement fee will be charged. All fees/charges for missing items will either be deducted from your security deposit check, or charged to your credit card. LTMV will make you aware of these charges before cashing any deposit checks or charging any credit cards, but the Guest must understand they are liable for these charges.
ITEMS LEFT IN UNITS BY GUESTS: It is the responsibility of the Guest to notify our office of items left in a Unit. Check all closets and drawers and look under beds. Personal items found in the Unit will be held for 20 days. The amount of postage will be charged for mailing items back.
AFTER HOURS ASSISTANCE: Please call Lake Tahoe Mountain Vacations at (530) 562-2663 if you require emergency assistance at any time, unless it is not time sensitive, please try to call between 9am & 9pm daily.
DISSATISFACTION WITH THE UNIT: If the rental home is found unsatisfactory upon arrival, please notify LTMV immediately. We will make every reasonable attempt to rectify the problem with the Unit you are in, or move you to another comparable Unit if deemed necessary, but refunds will not be made at that time.
LEGAL JURISDICTION: In the event of any Legal action whatsoever, made the by either the Guest (and/or any member of their party) or LTMV, it is hereby agreed by these parties that the courts of proper jurisdiction in these matters shall be those located in, Tahoe City, CA, and that mediation will be the agreed upon first choice of action.
Severability: Should any provision of this contract be found to be void, voidable, and illegal or in other way unenforceable, all other provisions herein shall remain in full force and effect.
Entire Contract: The foregoing is the entire contract between parties hereto. No other statements, promises, verbal agreements, assumptions and/or understandings are part hereof.
I HAVE READ THIS ENTIRE CONTRACT AND AGREE THAT I AM RESPONSIBLE FOR ALL OF THE ABOVE RULES. I AGREE TO BE RESPONSIBLE FOR ALL DAMAGES CAUSED BY MY PARTY. LTMV HAS MY EXPRESS PERMISSION TO COLLECT & CASH A SECURITY DEPOSIT (currently $300 for Ski Trails & $500 for the Village, subject to change with prior notification with each booking) IN THE EVENT OF DAMAGE (or smoking in the condo) CAUSED BY MYSELF OR MY PARTY WHILE STAYING IN A VACATION PROPERTY RENTED BY LTMV. I UNDERSTAND THAT, SHOULD IT BE NECESSARY, THIS AUTHORIZATION WILL BE UTILIZED BY LTMV TO CHARGE ME FOR ANY DAMAGES, MISSING ITEMS, ANY EXTRAORDINARY CLEANING TO THE UNIT AND ANY CHARGES ARISING FROM ANY VIOLATION OF THE VACATION RENTAL ORDINANCE BY MYSELF OR ANYONE IN MY PARTY IN THE AMOUNTS DESCRIBED HEREIN. SHOULD CHARGES FOR THESE DAMAGES, ETC. EXCEED THE INITIAL AUTHORIZATION OF $300.00, I HEREBY GIVE LTMV MY EXPRESS PERMISSION TO CHARGE MY CREDIT CARD FOR THE BALANCE OWED. I FURTHER AUTHORIZE LTMV TO CHARGE MY CREDIT CARD OR CASH MY RENT CHECK FOR ANY OUTSTANDING BALANCES DUE PRIOR TO ARRIVAL.
